Wage disputes: dynamics, resolution and challenges for an employer

Abstract:
Labour disputes on wages constitute the largest category of labour disputes before the courts. The practice of their resolution has a number of features, one of which is the preferential satisfaction of claims in favor of the employee. The author reveals the trends of labor disputes on wages, based on the analysis of statistical data of the judicial department of the Supreme Court of the Russian Federation over the past decade. New challenges faced by the employer (including a risk-based approach to inspection by regulatory authorities, monitoring of territories by the level of compliance with labor legislation, ranking of typical violations of labor legislation, mobile applications of Rostrud for filing complaints) were noted. It is concluded that the risks of identifying violations in the field of labor are comparable to the costs of constant provision of the requirements of labor legislation.
