Abstract:
The Resolution of the Constitutional Court of the Russian Federation No. 32-P of 06/15/2023, devoted to the recognition of Part 2 of Article 135 of the Labor Code of the Russian Federation partially inconsistent with the Constitution of the Russian Federation, not only led to the need to amend labor legislation, but also raised a number of practical questions about the admissibility and amount of reduction in incentive payments if employees have penalties.
At the same time, the research conducted by the authors shows that the Decision of the Constitutional Court does not create prerequisites for the appearance of serious problems for employers with the correct registration of labor relations and local regulations on remuneration.
According to the authors, the amendments to the Labor Code of the Russian Federation do not create any difficulties in concluding and implementing an effective contract with healthcare staff, which should include, among other things, the conditions for the implementation of incentive payments, that is, the grounds for their reduction.
The purpose of the study was to analyze the impact of the Decision of the Constitutional Court of the Russian Federation and the subsequent amendments to the Labor Code of the Russian Federation on the activities of medical organizations on the formation of wage systems, determining the amount of incentive payments, including the procedure for reducing these payments.
