In times of geopolitical and economic instability, the policies of central banks are the most sensitive to government regulation of the economy. This raises the question of the independence of central banks, as well as the question of determining their special legal status. Due to the uncertainty of the criteria for the special legal status of central banks that exists in scientific works, the goal of this article was to develop the theoretical foundations for determining the special legal status of the central bank and the practical foundations for assessing the independence of the central bank on the examples of Russia and China. To achieve this goal, theoretical methods of analysis and synthesis, the method of systematization, as well as the empirical method were used. The scientific novelty of the study consists in the systematization of the criteria of the special legal status of the Central Bank of Russia and the People's Bank of China. As a result of the stud,y the conclusion on the existence of a special legal status of the Central Bank of Russia and the People's Bank of China was formulated, while the independence of the Bank of Russia was assessed higher. The study is of interest to representatives of central banks, public authorities, as well as scientific researchers.
В условиях геополитической и экономической нестабильности политика центральных банков наиболее чувствительна к мерам государственного регулирования экономики. Отсюда встает вопрос независимости центральных банков, а также вопрос определения их особого правового статуса, что обуславливает актуальность исследования. Ввиду неопределенности относительно критериев особого правого статуса центральных банков, существующей в научных работах, целью данной статьи является развитие теоретических основ определения особого правового статуса центрального банка и практических основ оценки независимости центрального банка на примерах России и Китая. Для достижения данной цели использованы теоретические методы анализа и синтеза, метод систематизации, а также эмпирический метод. Научная новизна исследования состоит в систематизации критериев особого правового статуса центральных банков России и Китая. В результате исследования сформулирован вывод о наличии особого правового статуса Банка России и Народного банка Китая, при этом независимость Банка России оценена как более высокая.
