The article is aimed at conducting a political and legal analysis of the process of producing and institutionalizing citizens' digital rights in modern Russia. The authors focus on the problems, risks and prospects of ensuring the rights and freedoms of Russian citizens in the digital environment. The authors trace the evolution of Russian legislation and lawmaking, as well as, in part, international law in the field of regulation and enforcement of digital rights. The article emphasizes the need for further improvement of the regulatory framework governing relations in the field of digital technologies, and the creation of specialized bodies and mechanisms for monitoring the observance of citizens' rights in the digital space. The authors note that digital power in Russia and in the world is not actually regulated in any way, which creates additional risks for the citizens' rights and freedoms. The authors also point out the need to clearly define the boundaries of digital power and regulate the activities of digital corporations in order to prevent possible abuses and violations of citizens' rights. The authors identify such important tasks as increasing the level of digital literacy, developing civic participation and supporting institutions of human rights and public activities in order to effectively protect human and civil rights and freedoms in the digital space of the Russian Federation. This article may be useful to Russian government authorities, in particular, representatives of the legislative branch, in order to further improve the regulatory framework in the field of digital technologies. Статья направлена на проведение политико-правового анализа процесса продуцирования и институционализации цифровых прав граждан современной России. В фокусе внимания авторов проблемы, риски и перспективы обеспечения прав и свобод российских граждан в цифровой среде. Авторы прослеживают эволюцию российского законодательства и законотворчества, а также, от части, международного права в области регулирования и обеспечения цифровых прав. В статье подчёркивается необходимость дальнейшего совершенствования нормативно-правовой базы, регулирующей отношения в сфере цифровых технологий, и создания специализированных органов и механизмов контроля над соблюдением прав граждан в цифровом пространстве. Авторы отмечают, что «цифровая» власть в России и в мире пока фактически никак не регламентирована, что создаёт дополнительные риски для прав и свобод граждан. Авторы также указывают на необходимость четкого определения границ «цифровой» власти и регламентации деятельности цифровых корпораций для предотвращения возможных злоупотреблений и нарушений прав граждан. Не менее важными задачами авторы обозначают повышение уровня цифровой грамотности населения, развитие гражданского участия и поддержку институтов правозащитной и общественной деятельности в целях эффективной защиты прав и свобод человека и гражданина в цифровом пространстве Российской Федерации. Данная статья может быть полезна органам государственной власти России, в частности, представителям законодательной власти в целях дальнейшего совершенствования нормативно-правовой базы в сфере цифровых технологий.
